Bail is a means to get the
defendant released during the trial proceedings.
Bail is a security, usually a
sum of money, used by the court to ensure that the defendant comes back to court when required
to do so.
How the amount of bail is
determined:
The judge decides how much bail
will be paid. While there are many factors a judge can consider before setting bail, the two
most important are:

Whether or not the defendant is a
danger to the community; and

What the likelihood is that the
defendant will flee.
Options for release on
bail:
Release On Own Recognizance
If the Judge is convinced
the defendant is not a risk, the Judge may release the accused on a recognizance bond, commonly
referred to as an I-Bond which is a promise made before the Court, obliging defendant to appear
in court when he is required;
Cash Bail
The accused has the
option of;
-
paying the full cash amount of the
bond, in which case the court costs and fines are taken from the bond at the conclusion
of the case and the cash is returned or
-
deposit ten-percent of the face
amount of the bond in which case, ninety-percent is refunded less any fines or
further assessments the court may impose.
