If you have been stopped for a DUI:

  • Always be respectful to the police officers;
  • You have the right to remain silent from the moment you are stopped by the police. Respectfully refuse to talk or answer any questions. Remember that anything you say can and will be used against you;
  • Politely refuse to take any and all “street-side” field sobriety tests. Again, any information obtained from these tests can and will be used against you; and
  • In general, also refuse to take any breath or chemical testing unless you are absolutely certain you will test under the legal limit.

If you have been charged with a DUI:

Your driver’s license is already in the process of being suspended. Although it is not suspended the day you are charged, in most cases, your license will be suspended after the 45th day following the arrest. In addition, the penalties for a DUI can involve jail time and heavy fines, even for first time offenders.

If you are convicted of a DUI in Illinois:

In the state of Illinois, a DUI in its least severe form;

  • is a class A misdemeanor;
  • punishable by up to $2500 in fines and up to 364 days in jail.
  • In some cases, felony criminal charges may apply.
  • In almost all cases, an Illinois DUI conviction will automatically result in the revocation of your driver’s license. Revocation means permanent loss of your driving privileges until the Secretary of State decides otherwise.
