The Power To Move Forward

Paternity

Paternity is the state of being a father.

Establishing paternity

Establishing paternity is the legal process of officially determining
who the father of a child is and creating the existence of a father/child relationship.

The reasons to establish paternity:

If a child is born to an unmarried couple, there is no presumption that a certain individual is the father with the exception(s) listed below. As such, the father has no rights to the child and the child has no legal ties to the father.

Paternity ensures a child’s right to child support, health insurance, eligibility for benefits and rights of inheritance. In addition, it guarantees an unmarried father his parental rights to visitation (i.e. it affords him the right to seek custody, visitation, etc.) and requires he be contacted prior to the child being put up for adoption.

Typically, when a child is born out of wedlock,
paternity is established either by:

  • A paternity acknowledgement form which can be signed at the hospital. Signing this document has the same effect as a judgment establishing paternity. It is recommended that the man have genetic ( DNA) testing before signing; or
  • The mother or alleged father may file a petition in court seeking to establish a parent-child relationship.
