Personal Injury Law covers a wide array of conduct that results in people being physically or emotionally injured.

 

The law requires all persons and corporations to act in a cautious and careful manner to avoid causing injury to others. While there are many specific laws and/or statutes protecting a person’s right to be free from conduct which results in injury, the most basic of these protections is the common law tort of “negligence”.

 

In a negligence action, the injured party who sues for damages is called the plaintiff and the party being sued is called the defendant. To prove a negligence claim a plaintiff must prove that the defendant owed a duty to the plaintiff, failed in that duty (i.e. to be reasonably careful), and that damages resulted as a cause of that failure.   

 

The laws relating to personal injuries are primarily designed to have the person or company who negligently caused the injury to pay damages to fairly compensate injured persons for their loss.

What you need to do in the first few days or weeks after an injury has occurred to protect your rights to compensation:

  • Write down as much as you can about the accident itself,
    • witnesses,
    • location,
    • events surrounding the injury,
    • etc.;
  • Take pictures of the site of;
    • the accident,
    • your car (or other damaged property), 
    • your injuries,
    • etc.;
  • Keep a diary of;
    • how you are feeling,
    • the symptoms,
    • treatment and response to treatment 
    • the name(s), address(es) and phone number(s) of each medical treater that provided you with medical services;
  • Keep track of all actual losses as a result of the injury e.g.;
    • time lost from work, 
    • costs paid and/or bills for:
      • ambulance,
      • hospital,
      • doctors,
      • physical therapists,
      • prescriptions,
      • homecare,
      • etc.;
  • Make notes of all conversations you have with people involved in the injury or in the claim;
  • Preserve any physical evidence you have and take pictures if appropriate; and

To make sure your rights to compensation are protected, do not make any statements or sign anything without talking to us first.

The Social Security program is run by the U.S. government; and it is this program that provides benefits to those who are unable to work due to mental and physical problems. Don’t wait to file your claim for disability payments, as benefits begin from the date of the application. Contact www.ssa.gov for more information on this issue.

In all cases involving personal injury, certain statues of limitations and notice requirements apply. If you fail to take the appropriate action or file your case within the applicable time frame, you may be prevented from receiving any compensation for your injuries.
