Many criminal cases are
resolved without going to trial, by having both your attorney and the prosecuting attorney come
to an agreement as to the punishment to be imposed against you, in exchange for a plea of
guilty.
This process is known as
negotiating a plea or plea bargaining and resolves many of the criminal cases filed. In certain
circumstances, plea bargaining can be a way to avoid a potential harsh sentence in favor of
an agreed upon lighter sentence.
Why you might decide to plea
bargain
instead of go to trial:

To avoid the time and expense of a
lengthy trial;

To avoid the uncertainty of trial and
the risk of a harsher punishment; and/or

To avoid the publicity a trial could
involve.

How the negotiation process
works:
Either side may begin
negotiations over a proposed plea bargain, though obviously both sides have to agree before one
comes to pass.
Sometimes, plea bargaining
involves the defendant pleading guilty to a lesser charge or to one of several
charges.
It may also involve a guilty
plea as charged, with the prosecution recommending leniency in sentencing.
The judge makes the final
decision and is not bound to the proposed negotiated settlement, but generally agrees to the
terms.
