If you and your spouse separate, you can do it in one of two ways:

  1. an informal separation or
  2. a formal legal separation.

An informal separation

An informal seperation is basically whatever the two of you agree to.

A formal legal separation

A formal legal separation is more permanent and more complicated. A legal separation provides only limited relief and is usually as expensive as a divorce. Since people who get a formal legal separation usually wind up having to go through all the pain, time, and expense again later to get an actual divorce, a legal separation is only recommended in certain unique instances.

The circumstances under which to consider getting a formal legal separation instead of a divorce:

  • Some couples need to be separated but need to remain legally married, perhaps so one can continue to be insured for medical or other purposes by the other’s company;
  • If one spouse is paying maintenance (formerly known as alimony) to support the other spouse, it may be worth it to enter into a legal written separation agreement so that the person paying the support can use the money paid as a tax deduction; 
  • and/or Sometimes one of the spouses has a religious objection to divorce.

Beyond these reasons, it may not be wise to get a legal separation. 

 

If you are not sure you want to end the marriage, it might be better to reach a working arrangement for an informal separation.

 

You can then determine later to either reconcile or divorce.
