In Illinois, non-custodial parents are entitled to reasonable
visitation rights with their children. The law makes this right an “entitlement” which means the
non-custodial parent can not be deprived of visitation without a full court hearing.
Illinois does not recognize a “standard visitation” schedule.
Visitation issues are unique to each family. Typically, however, the non-custodial parent has
visitation with his or her child every other weekend, every other major holiday and two to four
weeks in the summer. However, a judge is likely to approve of any visitation that the parties agree
to between themselves.
Interestingly, Illinois
law gives the “right” of visitation to the
non-custodial parent and the “privilege” of visitation to grandparents, great-grandparents,
siblings and stepparents; but the children, who have to go on visitation, have no rights
spelled out in the law. There is nothing that says the children have any right to visitation.
There is no mechanism in Illinois law to compel a non-custodial parent to exercise his or
her visitation rights, although there have been some Court cases where visitation has been
compelled.
It is also important to note that child support and visitation have nothing to do with each other.
Both parents have the right to spend time with their children regardless of the payment or
non-payment of child support.
